The events of September 11 have complicated Flight Training greatly. We have attempted to research the TSA & FAA Requirements related to flight training; in particular, flight training of foreign students and flight training of ALL students in an aircraft over 12,500 lbs (i.e., the Albatross). We have compiled the information we researched and links to the original sources on this page for your benefit.
While we are not in a position to provide legal guidance, it appears both the NBAA and the EAA believe that a waiver is required to perform ANY flight training including Recurrency & Proficiency rides in any aircraft weighing over 12,500#.

There are three areas of concern relevant to Albatross Flight Training:
First is NOTAM FDC 2/5167 which concerns ALL flight training in aircraft over 12,500# - Note that this NOTAM was issued 11 June, 2002 and reissued on 24 May, 2004
This requirement is administered via FAR part 99 - Security Control of Air Traffic
Note that this rule applies to ALL flight training and is not related to citizenship or nationality
Under this NOTAM, flight training under Part 91 of any kind (including check rides, recurrency and PPEs) in aircraft over 12,500# (i.e., the Albatross) is specifically prohibited . However a waiver can be obtained to allow one training event to take place.
A blanket waiver for a specific event (i.e., Boulder City Albatross Seminar) may also be obtained. Contact us for further information on blanket waivers
Second is the TSA Alien Flight Training Rules concerning flight training of any Non-US citizen or resident alien
Any foreign student wishing to receive training in the USA, regardless of aircraft size or type of training, must register with the TSA and comply with numerous requirements before beginning training. This process involves fingerprinting and may take several weeks.
To register, the foreign student must identify the TSA Registered Flight Training Provider with whom they will train.
The rule states that U.S. citizens need only to prove their status to be exempted from the TSA check, by showing a passport or other identification. This can be demonstrated with a logbook entry for the student and the instructor. You must provide either a passport a certified Birth Certificate with two forms of photo ID.
Third, all Flight Instructors are required to have completed the TSA Flight School Security Awareness Training by 18 January, 2005.
